Terminology and Definitions:

User acknowledges and accepts the following terminologies, and its definitions that are referenced in the proceeding Terms of Service: Please note, unless explicitly stated in a different context, the terms "user", "you", "you are", "you're", and "your" all address the same individual who is reviewing this Terms of Service, registering, logging in, and engaging with Mingle99 through this site.

1. Mingle99 is an e-commerce platform which enables the user to engage with this platform in order to shop, and purchase goods.

Inventory Availability Policy, Terms of Service and Disclaimer

1. Mingle99 strives to ensure all its product listing's are up to date, and current. However, there may be times where an inventory may not be available even if it is shown as available on the site. User acknowledges and accepts that Mingle99 does not guarantee, nor provides assurance of the availability of products listed on Mingle99.

2. In the event an item purchased is no longer available for sale, User acknolwedges and accepts that Mingle99 will send an email communication notifying the user of the unavailability, and proceed to refund the user immediately

3. Unless specifically listed, all items sold on Mingle99 are brand new and have never been used, nor opened upon procurement from authorized distribution channels.

Check Out and Payment Policy

1. User acknowledges and accepts that upon check out, user will be required to register with Mingle99, and provide the relevant information such as First and Last Name, Shipping Address prior to placing an order.

2. Mingle99 does not store, nor process any credit card based transaction locally on the site it self. All payment transaction is processed by PayPal. Upon a completion of transaction, Mingle99 will store the transaction information processed by PayPal for it's record and tracking purpose.

3. User acknowledges and accepts that upon checkout, the transaction will be completed (including the submittal of credit card information) on PayPal's site. As such, user is responsible and accepts all liability for providing payment information on a third party site.

Shipping Policy Terms and Service

1. Mingle99 does not guarantee, nor provides any assurance that a product will be delivered as per user's specification after a purchase has been made.

2. Mingle99 does not guarantee nor provide any assurance that a product will be procured or delivered after a purchase has been made. In the event Mingle99 is not able to deliver the product as agreed upon, Mingle99 will communicate to the user as such, and provide a full refund to the user.

3. Mingle99 reserves the right to procure and leverage the services offered by a third party, and any other services of choosing to deliver goods and products to a user after purchase.

4. Mingle99 strives to ensure that all products shipped are done so with no alteration or damage to the product it self. Mingle99 will not be held liable or responsible in the manner in which the product is delivered by a shipping service, nor will Mingle99 be held liable in the condition the product reaches the customer.

5. Unless stated otherwise in a listing, all shipping service is free. At a minimum, Mingle99 uses ground shipping for delivering orders. Mingle99 may or may not offer expedited shipping for an extra charge for the listed products.

6. Mingle99 reserves the right to change the terms and conditions regarding the shipping policy which may include charging for shipping in certain purchases.

Disclaimer towards Shipping Service

1. Mingle99 reserves the right to use the most optimal shipping/carrier service to deliver an item. Currently, Mingle99 leverages UPS to deliver all orders, however, Mingle99 may opt to use another carrier service as it sees fit.

2. Mingle99 is not responsible nor liable in the manner a shipping or carrier service conducts it self, or operates in the manner it delivers an order which includes but not limited to losing an order, damaging an order, or any delay of delivery.

3. In the event an order is lost, or damaged upon delivery, user is responsible for notifying such incident to Mingle99 and submit the appropriate evidence. Mingle99 commits to reviewing the evidence, and providing the user with a full refund if the shipping service is found to be at fault.

Refund Policy Policy Terms and Service

1. All orders, unless stated otherwise during time of check out, or the listing, has a return policy of 60 days. Within the 60 day time frame, after a user has taken delivery of the item, the user can return the ordered item(s) for a full refund to Mingle99.

2. User acknowledges and accepts that all items returned within 60 days of procurement will do so by including all the original material that came with the item it self. User acknowledges and accepts that the item will be returned without any explicit physical damage inflicted by the user. In the event it is determined that the item was physically altered, or damaged by the user prior to return, a full refund will not be provided, and an assessment will be made by Mingle99 to determine if a partial refund can be provided, or non at all.

3. A return shipping label will be provided free of cost by Mingle99 to the user upon requesting a return within 60 days of procurement of the item. User acknowledges and accepts the carrier chosen for the return shipping label will be based on Mingle99's discretion.

4. User acknowledges and accepts that once the returned item is in the possession of Mingle99, Mingle99 will inspect the item, and if the item has been returned with all it's original contents, and no explicit physical damage is observed, a full refund will be provided to the user within 7 days of procurement of the returned item by Mingle99.

5. User acknowledges and accepts that in the event Mingle99 suspects that the user purposely sent back another part with the intent of committing fraud, Mingle99 will involve the appropriate law enforcement authorities and report the user without any prior notice. In addition, the user will not be provided with any refund, nor any communication will be sent by Mingle99 of such action. Furthermore, in such an event, Mingle99 will not respond to user in the event user inquires the status of the refund.

Rebate Policy and Terms of Service

1. Mingle99 may provide rebates to some of the items listed. Mingle99 does not guarantee, nor provides assurance that every item will have a rebate. All rebate offers are subject to Mingnl99's discretion.

2. User acknowledges and accepts that the rebate amount provided by Mingle99 will solely be based upon Mingle99's discretion.

3. User acknowledges and accepts that Mingle99 will provide the time frame upon when a rebate can be redeemed by means of email communication, or instructions provided in the order, or through the site it self.

4. User acknowledges and accepts that unless explicitly listed, all rebates can be redeemed directly from Mingle99 through the "Rebate" section of the page.

Inclusion of Brochures and Marketing Material Policy

1. User acknowledges and accepts the Mingle99 reserves the right to include other brochures and marketing materials within a shipment.

2. Mingle99 commits to ensuring that all brochures and marketing material included within a shipment are ethical in nature, and will not contain information that may be perceived as offensive by the user or by any of user's associates.

Pricing Terms of Service:

1. Mingle99 reserves the right to change its pricing policy, and prices of the items listed on Mingle99 without any notice to the user prior to a new sale

2. Mingle99 commits to creating an environment for the user where the user gets the cheapest and best deals for a product. In the event, the user wishes to purchase an item for a cheaper price, user acknowledges and commits to communicating with Mingle99 via email with an alternative price.

3. In the event the user does communicate with Mingle99 with an alternative price for a product with the intent of bargaining, Mingle99 does not guarantee that the user's offer will be accepted, and may insted opt to refuse the proposal, or provide an alternative price for the item of interest.

General Acknowledgement of Terms of Service

1. Mingle99 reserves the right to change its terms and conditions at any time

2. User acknowledges and accepts the terms of service, including any updates, upon every login

3. By using this service user acknowledges that he or she is at least 18 year of age

4. You agree to represent yourself honestly and accurately

5. You acknowledge that in the event that it is brought to the attention of Mingle99 that you are suspected of engaging in malicious or derogatory behavior, your account will be suspended indefinitely by Mingle99 with or without any prior notice or warning

6. You acknowledge that in the event that it is brought to the attention of Mingle99 that you are suspected of spamming or sending message storms to other users of this platform, your account will be suspended indefinitely by Mingle99 with or without any prior notice or warning

7. You acknowledge that in the event that it is brought to the attention of Mingle99 that you are suspected of harassing another user of this platform, your account will be suspended indefinitely by Mingle99 with or without any prior notice or warning

13. User is prohibited and forbidden towards engaging in any type activities on this platform which is considered illegal by Law as outlined by any type of government including domestic or international

14. User acknowledges that Mingle99 is not affiliated in anyway with, nor endorsed by Amazon or E-Bay or PayPal or any other third party site

16. User is aware of the risk and dangers that are associated with a product prior to purchasing. Mingle99 is not liable for any harm that a product may cause to a user upon purchase, and delivery

17. Mingle99 is not liable, nor makes any guarantee for the quality of the product sold

18. User is aware of the laws and limitations that his or her state imposes for purchasing products or certain types of products from Mingle99. Therefore, user is liable for any violation or breaking of any such laws within his or her own state. Mingle99 does not take any liability towards the violation of such law.

19. Mingle99 reserves the right to refuse service to any user, and refuse to sell any product that is listed. Furthermore, Mingle99 will not sell any products to user that is not listed.

Privacy Policy

1. Mingle99 retains ownership of user related information that has been published on the Mingle99 platform. Information includes but not limited to 1) Profile Information 2) Images 3) Description of Product 4) User Id 5) Password 6) Buyer's price preference 7) Buyer's address, Firsrt Name, Last Name, and Email address 8) All email communications with Mingle99

2. Mingle99 reserves the right to track and monitor the manner in which a user (whether logged in or as a guest) navigates and interacts on any of the pages within the Mingle99.com domain. Tracking can be done by means of (but not limited to) creating cookies on the users machine for session tracking and storage purpose, custom built scripts on mingle99.com, or through third party scripts designed to monitor and track a user's navigation or behavior. Information tracked by Mingle99 in regards to a user (but not limited to) includes IP Address. This information will only be used to track a user's behavior towards the site so that Mingle99 can improve its business offering. Mingle99 may also use the tracking information to block the user if the user is suspected of malicious or abusive behavior towards Mingle99.com

3. User is responsible for ensuring that they do not mention any personal identifiable information (PII) about themselves or anyone during any correspondence with Mingle99. Mingle99 will not commit nor censor any PII data and will store all communication in its back end database as is

Disclosure, and Terms of Service of Privacy Policy concerning User's PII (Personal Identifiable Information)

1. Mingle99 identifies certain information collected from the User prior to purchasing an item as PII. Information pertaining to PII includes (but not limited to) First Name, Last Name, Email Address, Shipping Address, Bill To Address, and order history of items purchased associated with the User.

2. Mingle99 commits to ensuring that all PII data provided by the user on this platform is stored securely, and will employ reasonable measure to protect user's PII information as per industry standards.

3. In the event of any security incident which leads to a user's information being breached, or being disclosed in an unauthorized manner, or stolen, Mingle99 commits to notifying the user of such breach, and disclose all appropriate indemnification if applicable.

4. Mingle99 reserves the right to input further attributes about the User that would pertain to PII from this platform as appropriate prior to making a purchase.

5. User reserves the right to communicate to Mingle99 by email to purge all the User's PII related information, and the User's account. In the event of such a request, Mingle99 will still retain User's order transaction PayPal id so that it can be referenced via PayPal.

6. User acknowledges that Mingle99 does not have any say or control of the order history that is stored by PayPal, and therefore Mingle99 will not be in a position from making any changes (including any form of purging data) to User's PII data stored by PayPal. Furthermore, user accepts PayPal's privacy and policy prior to making a purchase from Mingle99.

Purchasing from Mingle99 Terms of Service

1. Mingle99 is a California based company. User acknowledges that Mingle99 will charge the appropriate sales tax as relevant to the state indicated by the user through the shipping address. Users residing outside of California are responsible for being aware of their state tax laws.

2. User acknowledges that he or she is aware of the impact the product will have upon purchasing it, or possessing it, or using it. Mingle99 will not be held liable in the event user incurs any form of harm from the product upon purchasing it, or possessing it, or using it. Incurring any form of harm from a product includes but not limited to physical harm, mental harm, or financial harm.

3. User acknowledges that Mingle99 does not guarantee, nor offers any service level agreement or expectation towards any form of communication, or services provided.

4. Mingle99 uses PayPal to process all payments. User acknowledges and agrees to use PayPal as a payment processing gateway through Mingle99 for any purchases made on Mingle99.

5. User acknowledges and agrees that Mingle99 reserves the right to change the method of payment, and the payment processing gateway at any given time.

Disclaimer for Mingle99 products sold through other Third Party sites:

In the event a user wishes to purchase our products from another third party site such as Ebay, the following terms and service applies towards such a transaction:

1. Mingle99 sells goods through other e-commerce platforms as well. Mingle99 is not liable, nor guarantees, nor provides assurance towards the cyber security posture of any third party site from where Mingle99 products are sold

2. Mingle99 is not liable, nor guarantees, nor provides assurance towards the security of your personal, financial, and general data on any third party site from where Mingle99 sells its product should the user decide to purchase items from Mingle99 from that third party platform

3. Mingle99 does not guarantee, nor provides any assurance that a product will be sold to your preferred third party site

4. Mingle99 does not guarantee, nor provides any assurance that a product will be sold at your preferred price

5. User is responsible for providing accurate contact information to Mingle99, and to the third party so that Mingle99 can communicate with the user. In the event you fail to do so, Mingle99 will not be held responsible, nor liable towards the impact that may result towards your purchase including but not limited to delay in communicating any critical update to your order, failing to deliver a purchased product, and processing a refund request

6. You acknowledge the terms of service, restriction, and limitation, placed by the third party, also applies to any negotiation, sales, and dispute that occur between Mingle99 and your self

7. In the event Mingle99 does carry the item(s) that you wish to buy, the normal terms, restriction and limitation will be applied towards selling the item(s) from the third party site

8. User acknowledges that in case of a purchase, he or she will be required to purchase the item from an agreed upon third party site from where Mingle99 will sell the item prior to any delivery or shipping

Security

1. Mingle99 does not offer any assurance or validation of the security posture of any user's end point devices such as laptops, mobile devices, tablets etc that may access this site.

2. User acknowledges that he or she is prohibited to carry out any form of cyber attack towards Mingle99's website, software, platform, and infrastructure. In the event of any cyber security attack towards any network, or application, or data asset owned by Mingle99, Mingle99 will carry out the appropriate investigation of the attack, and if necessary submit user information suspected of carrying out the attack to US and International Law enforcement agencies such as the FBI.

4. There are risks involved in submitting private information through the internet, and Mingle99 does not make any warranties, express or implied, about the security of your information on this site.
